Terms of service for attention studies for business

Effective from 6 November 2026

This is a translation for information purposes. The binding version is the Polish Regulamin usługi badań uwagi dla firm. In case of any discrepancy, the Polish version prevails.

§ 1. Service provider and scope

  1. The service is provided by TGV Sp. z o.o., with its registered office in Warsaw, Al. Niepodległości 54/34, 02-626 Warsaw, Poland, entered in the register of entrepreneurs of the National Court Register (KRS) kept by the District Court for the Capital City of Warsaw under number 0000534661, tax ID (NIP) 5213684806, share capital PLN 5,000 ("Provider"). Contact: kontakt@uwazni.org.pl.
  2. The service consists of studying the attention of a selected target group on a page, article or video indicated by the Client and delivering a report ("Study").
  3. These Terms apply to businesses only ("Client").
  4. To a business that is a natural person and concludes a contract directly related to their business activity, where the contract shows that it is not of a professional nature for them (Article 3855 of the Polish Civil Code), the provisions on unfair contract terms, withdrawal from distance contracts and statutory warranty apply to the extent provided for consumers. Provisions of these Terms limiting the Provider's liability do not apply to such a business insofar as they conflict with those provisions.

§ 2. Conclusion of the contract

  1. The Client sends an enquiry through the configurator on the website or by email. Prices in the configurator and price list are estimates and do not constitute an offer within the meaning of the Polish Civil Code.
  2. The Provider sends an offer with the price and launch date, usually within one business day. The contract is concluded when the Client accepts the offer in documentary form (for example by email).

§ 3. Client's obligations

  1. The Client commissions studies only of pages it holds rights to, or for which it has the owner's consent, and provides the necessary access details.
  2. Traffic generated by a Study is tagged with the parameter utm_source=uwazni. The Client may not use it in audience statistics, audience measurement studies, ad serving or ad billing, or present it as organic traffic.
  3. The Client ensures that third-party ad impressions or clicks generated by Study participants on the tested page are not billed during the Study.

§ 4. Carrying out the Study

  1. The Provider selects the sample according to the target group criteria described in the offer and in the Methodology section.
  2. The first visits are usually visible in the Client's Google Analytics about a minute after the Study starts. Standard Google Analytics reports fill in within 24–48 hours, in line with Google's data processing.
  3. The report contains aggregated results.
  4. The Provider does not report results for subgroups below the reliability threshold.

§ 5. Remuneration

  1. Remuneration is set by the accepted offer and is expressed in Polish zloty (PLN). VAT is added to net prices at the applicable rate, or the reverse charge mechanism applies where the law provides for it.
  2. The Provider issues a VAT invoice after the offer is accepted, payable within 14 days unless the offer states otherwise.
  3. If the Provider does not achieve the full sample size, the remuneration is reduced proportionally.

§ 6. Results and data

  1. The Client receives a licence to use the report for its own purposes, including in communication with business partners, without time or territorial limitations.
  2. The Provider may use anonymised, aggregated Study data to develop its methodology and create benchmarks, without disclosing the Client or the tested page.
  3. The Client does not receive Study participants' personal data. If the Provider processes personal data on the Client's behalf in the course of a Study, the parties sign a data processing agreement.

§ 7. Confidentiality

The parties keep confidential the information obtained in connection with the Study, in particular page content before publication. At the Client's request the parties sign a separate non-disclosure agreement (NDA).

§ 8. Liability

  1. The Provider's liability is limited to the remuneration for the given Study and does not cover lost profits, except for damage caused intentionally.
  2. The report is research in nature and does not guarantee campaign or sales results.

§ 9. Complaints

The Client submits complaints by email within 14 days of receiving the report. The Provider responds within 14 days.

§ 10. Technical requirements and rules of use

  1. The Provider provides the following electronic services: the configurator and enquiry forms, the sample report, email correspondence and, once launched, the client panel.
  2. Using the services requires a device with internet access, an up-to-date browser with JavaScript enabled and an active email address. Reports are delivered in PDF and CSV format.
  3. The Client may not provide unlawful content, including commissioning studies of pages containing such content.

§ 11. Final provisions

These Terms are governed by Polish law. Disputes are resolved by the court having jurisdiction over the Provider's registered office. The Provider informs Clients of changes to these Terms by email at least 14 days before they take effect. Studies commissioned earlier remain subject to the previous terms.
